1. Acceptance of these terms

This website (the "Site") is owned and operated by European Piano Mastery Elite Academy ("the Academy", "we", "us" or "our"). By opening, browsing or otherwise using the Site in any way, whether manually or by automated means, you confirm that you accept these Terms and Conditions, our Privacy Policy, and any further terms that apply to particular areas of the Site or to specific programmes, products or services we offer. If you do not accept them, please stop using the Site.

We may revise these Terms and Conditions or introduce new conditions of use from time to time. The current version will always be published on this page, and your continued use of the Site after a revision is posted means you accept the updated terms.

2. Intellectual property and the licence we grant you

The Site and everything made available through it, including lesson materials, videos, audio recordings, sheet music, exercises, written text, graphics, logos and course structures, belongs to the Academy or to our licensors and is protected by copyright, trademark and other intellectual property laws. The Site is made available for your own personal, non-commercial study only.

Unless we have given you written permission, you may not copy, reproduce, republish, upload, post, transmit, translate, adapt, sell, licence, publicly perform, create derivative works from, or otherwise distribute any material from the Site in any medium, including by email, file sharing or social media. You may download or print a single copy of an individual page for your own private study, provided you keep all copyright and ownership notices intact.

3. The licence you grant us

If you send or post any material to us or to our community spaces, including comments, questions, recordings of your playing, photographs, videos or messages sent by email or text, you confirm that you own that material or have the owner's permission to submit it, and that you are at least thirteen years of age.

By submitting such material you grant us, and anyone we authorise, a royalty-free, worldwide, perpetual, irrevocable, non-exclusive licence to use, copy, adapt, publish, distribute, translate and display it, in whole or in part, in any medium now known or later invented, for any purpose connected with the Academy. You also allow us to identify you as the author by name, screen name or email address where we consider it appropriate. We are under no obligation to use or display anything you submit, and we may stop using it at any time.

4. Linking and framing

You are welcome to link to the Site, provided the link does not suggest any sponsorship, endorsement or partnership that does not exist. You may not frame the Site, inline-link to our files, or incorporate our content into another website, application or service without our prior written permission.

5. Third-party content and disclaimers

The Site may contain links to websites operated by other people. A link is not an endorsement, and we have no control over, and accept no responsibility for, the content, products, services or privacy practices of any third-party site.

Any views, advice or statements expressed by third parties on or through the Site are those of their authors and not of the Academy. All information, products and services offered on or through the Site are supplied "as is" and without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we exclude all implied warranties, including those of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, free of viruses, or that any defect will be corrected, nor do we make any promise about the accuracy, completeness, timeliness or reliability of the material on the Site.

6. Indemnity

You agree to defend, indemnify and hold harmless the Academy, its affiliates, successors, assignees and licensees, and their respective owners, directors, officers, agents and employees, against any claim, action, damage, liability, cost or expense, including reasonable legal fees, arising from your breach of any obligation, warranty or representation set out in these terms.

7. Purchases and enrolment

Some areas of the Site allow you to enrol in programmes or purchase products and services, whether supplied by us or by third parties. Where a purchase is handled by a third-party merchant or payment provider, that provider may collect information directly from you and may operate under privacy and data-collection practices different from ours; we are not responsible for those practices. Additional terms may apply to a specific programme or product, and those terms will be presented to you before you complete your purchase.

You agree that you are financially responsible for every purchase made through the Site by you or by anyone acting on your behalf, and that you will not make purchases for speculative, false or fraudulent purposes. Purchases are for your own personal use. Sharing, reselling or redistributing access to a programme is not permitted, is an infringement of our copyright, and may result in access being withdrawn without refund.

If a scheduled payment is declined, access to premium material may be suspended automatically. This most often happens because a card has expired. We will make reasonable efforts to contact you, and access will be restored once the payment issue has been resolved.

8. Community spaces and acceptable use

We may run forums, group calls, comment areas, chat rooms and other spaces where members can interact. You alone are responsible for what you post or send. As a condition of using the Site you agree that you will not:

restrict or spoil another member's use and enjoyment of the Site; impersonate any person or misrepresent your connection with any person or organisation; interfere with or disrupt the servers or networks used to run the Site; encourage or assist unlawful activity, or anything likely to cause injury or damage; attempt to gain unauthorised access to the Site or to any account, system or network connected to it; obtain material or information by any means not deliberately made available through the Site; post or transmit anything unlawful, threatening, abusive, defamatory, obscene, hateful or otherwise objectionable; post material that infringes another person's copyright, trademark, privacy or other rights; upload anything containing a virus or other harmful component; use the Site for advertising, soliciting or commercial promotion without our written approval; or harvest email addresses or other personal information belonging to other members.

Anyone who does not comply with these conditions may be removed from our community spaces and refused further access. We may edit, refuse to publish or remove any user content at any time, and we may disclose such content where necessary to comply with the law or to protect our members, our staff or ourselves. We have no obligation to monitor community spaces, but we reserve the absolute right to do so. Our aim is to keep every community we run genuinely valuable for its members, and we reserve the right to remove anyone at any time in order to protect that.

9. Registration and passwords

To use certain features you may need to register and provide accurate, current and complete information about yourself. If we have reasonable grounds to believe that the information you have given is untrue, inaccurate or incomplete, we may suspend or close your account and refuse further access to the Site. Our handling of the information you supply is governed by our Privacy Policy.

You are responsible for keeping your username and password confidential and for everything that happens under your account, whether or not you authorised it. Please tell us immediately if you become aware of any unauthorised use of your account or any other breach of security, and log out at the end of each session.

10. Limitation of liability

To the fullest extent permitted by law, and including in cases of negligence, neither we nor our affiliates will be liable for any direct, indirect, incidental, special or consequential loss arising out of the use of, or inability to use, the Site, our emails, our community spaces, our programmes, our products or any third-party material or service made available through the Site, even if we have been advised of the possibility of such loss. Some jurisdictions do not permit the exclusion of certain categories of loss, in which case our liability is limited to the maximum extent that the law allows. You specifically acknowledge that we are not liable for the conduct of any other user. If you are unhappy with the Site, with any material on it, or with these terms, your sole and exclusive remedy is to stop using the Site.

11. No guarantee of musical results

The Academy teaches piano technique, musicianship and practice method. Musical progress depends on many personal factors, including your starting level, the instrument available to you, the time you devote to practice and the consistency with which you apply what you learn. Nothing on the Site is a promise or guarantee of any particular standard, speed of improvement, examination result or professional outcome. Any examples of student progress that we share are illustrative and are not a representation of typical results.
